{"id":49528,"date":"2026-04-30T00:20:19","date_gmt":"2026-04-29T21:20:19","guid":{"rendered":"https:\/\/mk.gen.tr\/hud-proposes-rollback-of-equal-access-rule-protections\/"},"modified":"2026-04-30T00:20:19","modified_gmt":"2026-04-29T21:20:19","slug":"hud-proposes-rollback-of-equal-access-rule-protections","status":"publish","type":"post","link":"https:\/\/mk.gen.tr\/tr\/hud-proposes-rollback-of-equal-access-rule-protections\/","title":{"rendered":"HUD proposes rollback of equal access rule protections"},"content":{"rendered":"<p>The <strong>U.S. Department of Housing and Urban Development <\/strong>(<a href=\"https:\/\/www.housingwire.com\/podcast\/hud-secretary-scott-turner-on-cutting-energy-regulations-for-new-construction\/\">HUD<\/a>) has proposed rolling back protections for gender identity and sexual orientation in nearly 50 housing regulations, a move that is drawing criticism from affordable housing advocates who say the changes could further marginalize vulnerable communities.<\/p>\n<p>The <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/04\/28\/2026-08244\/equal-access-to-housing-in-hud-programs-revisions\">proposed revisions<\/a> to HUD\u2019s Equal Access Rule were published in the <strong>Federal Register<\/strong> on Tuesday. The changes would remove references to \u201cgender\u201d and \u201cgender identity\u201d from HUD regulations and replace them with \u201csex,\u201d as defined by President Donald Trump\u2019s<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/defending-women-from-gender-ideology-extremism-and-restoring-biological-truth-to-the-federal-government\/\"> January 2025 executive order<\/a>, \u201cDefending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.\u201d<\/p>\n<p>Per the proposed rule, HUD said the revisions are intended to \u201charmonize\u201d its regulations with the executive order by ensuring access to certain HUD-funded facilities is determined \u201cbased on his or her immutable biological classification as either male or female rather than the ever-shifting concept of self-assessed gender identity.\u201d<\/p>\n<p>The proposal would also allow grant recipients, housing providers and operators of HUD-funded programs with single-sex or sex-specific facilities \u2014 including emergency shelters and facilities with shared sleeping quarters or bathrooms \u2014 to request \u201creasonable assurances and evidence\u201d to verify an individual\u2019s sex.<\/p>\n<p><a href=\"https:\/\/www.housingwire.com\/winner-profile\/2024-woman-of-influence-tai-christensen\/\">Tai Christensen<\/a>, co-founder and CEO of <strong>Origin &amp; Oak Creative<\/strong> and an affordable and equal opportunity housing advocate, said the proposal moves in the wrong direction at a time when the industry should be focused on expanding housing access.<\/p>\n<p>\u201cI strongly oppose HUD\u2019s proposed changes to its Equal Access regulations,\u201d Christensen said in a statement. \u201cAt a time when we should be expanding access to safe, affordable housing, this rule risks further marginalizing the most vulnerable individuals and others already facing housing insecurity.\u201d<\/p>\n<p>Christensen added that housing policy should focus on reducing barriers to homeownership and housing stability.<\/p>\n<p>\u201cFrom a housing and mortgage industry perspective, our focus should remain on creating opportunities for creditworthy borrowers, including those in disadvantaged communities who are working to achieve homeownership and build <a href=\"https:\/\/www.housingwire.com\/articles\/gen-x-millennials-set-to-inherit-trillions-in-real-estate-wealth\/\">intergenerational wealth<\/a>,\u201d she said.<\/p>\n<p>The public comment period for the proposed rule remains open through June 29, 2026.<\/p>","protected":false},"excerpt":{"rendered":"<p>The U.S. Department of Housing and Urban Development (HUD) has proposed rolling back protections for gender identity and sexual orientation in nearly 50 housing regulations, a move that is drawing criticism from affordable housing advocates who say the changes could further marginalize vulnerable communities.
