{"id":48964,"date":"2026-04-17T20:22:40","date_gmt":"2026-04-17T17:22:40","guid":{"rendered":"https:\/\/mk.gen.tr\/mba-backs-cfpb-strategic-plan-urges-broader-mortgage-rule-relief\/"},"modified":"2026-04-17T20:22:40","modified_gmt":"2026-04-17T17:22:40","slug":"mba-backs-cfpb-strategic-plan-urges-broader-mortgage-rule-relief","status":"publish","type":"post","link":"https:\/\/mk.gen.tr\/tr\/mba-backs-cfpb-strategic-plan-urges-broader-mortgage-rule-relief\/","title":{"rendered":"MBA backs CFPB strategic plan, urges broader mortgage rule relief"},"content":{"rendered":"<p>The <strong>Mortgage Bankers Association<\/strong> (<a href=\"https:\/\/www.housingwire.com\/articles\/imb-profits-improve-2025\/\">MBA<\/a>) on Friday submitted a letter to the <strong>Consumer Financial Protection Bureau <\/strong>(<a href=\"https:\/\/www.housingwire.com\/articles\/house-credit-reporting-bills\/\">CFPB<\/a>) to support the bureau\u2019s proposed 2026\u20132030 strategic plan, backing efforts to reduce regulatory burdens while urging the agency to go further in easing mortgage rules that expand credit access.<\/p>\n<p>The <a href=\"https:\/\/www.consumerfinance.gov\/rules-policy\/notice-opportunities-comment\/open-notices\/we-invite-your-feedback-on-our-draft-strategic-plan-for-fy-2026-2030\/\">draft strategic plan<\/a>, which the CFPB published for public comment on March 13, outlines the agency\u2019s three primary goals: addressing pressing threats to consumers; reducing what it describes as unwarranted regulatory burdens; and strengthening the agency\u2019s governance and culture. The public feedback submission period ended on Friday.<\/p>\n<p>Under the first goal, \u201cAddress Pressing Threats to Consumers,\u201d the bureau said it will focus <a href=\"https:\/\/www.housingwire.com\/articles\/cfpb-ends-multiple-lender-consent-orders-opens-few-new-cases\/\">enforcement<\/a> and supervision on \u201ctangible\u201d consumer harm, particularly cases involving measurable financial losses.<\/p>\n<p>The goal involves several objectives to combat <a href=\"https:\/\/www.housingwire.com\/articles\/mortgage-fraud-risk-q4-2025\/\">fraud<\/a>; protect servicemembers and <a href=\"https:\/\/www.housingwire.com\/articles\/veterans-united-dismiss-respa-suit\/\">veterans<\/a> in the <strong>U.S. Department of Veterans Affairs<\/strong> (VA) loan space; and ensure what it calls \u201cfair banking,\u201d including scrutiny of potential \u201cdebanking\u201d practices tied to political or ideological factors.<\/p>\n<p>The agency also signaled a shift in enforcement priorities, stating it intends to return money directly to affected consumers rather than relying on fines that feed into its civil penalty fund.<\/p>\n<p>The second goal, \u201cReduce Unwarranted Regulatory Burdens,\u201d includes several objectives, including the need to \u201csystemically identify and address outdated, unnecessary, or unduly burdensome regulations,\u201d and to \u201cminimize regulatory burden by eliminating duplicative supervision or supervision outside of the CFPB\u2019s authority.\u201d<\/p>\n<p>\u201cMBA agrees with the aim of the strategic plan to concentrate the CFPB\u2019s resources on identifying and addressing pressing threats to consumers, reversing instances of regulatory overreach, and lowering the compliance and liability costs associated with consumer financial products,\u201d <a href=\"https:\/\/www.housingwire.com\/podcast\/mbas-pete-mills-on-gse-reform-and-legislative-priorities\/\">Pete Mills<\/a>, the MBA\u2019s senior vice president of residential policy and strategic industry engagement, said in the letter.<\/p>\n<p>The trade group praised recent CFPB actions that align with these goals, including the rollback of a proposed rule requiring certain nonbank firms to report enforcement orders to a federal registry that became effective in October 2025.<\/p>\n<p>It also backed the bureau\u2019s move away from <a href=\"https:\/\/www.housingwire.com\/articles\/theres-a-new-enforcement-playbook-for-mortgage-lenders\/\">\u201cregulation by enforcement,\u201d<\/a> saying it supports limiting enforcement to cases involving clear, measurable consumer harm.<\/p>\n<p>MBA urged the CFPB \u201cto incorporate the <a href=\"https:\/\/www.housingwire.com\/tag\/trump-administration\/\">Trump administration<\/a>\u2019s recent <a href=\"https:\/\/www.housingwire.com\/articles\/trump-mortgage-credit-order\/\">executive order on mortgage credit<\/a> and to ensure any regulatory relief is applied broadly across the market \u2014 not limited to smaller banks \u2014 so borrowers across all lender types can benefit from lower costs and improved access to credit.\u201d<\/p>\n<p>MBA pressed for adjustments to <a href=\"https:\/\/www.housingwire.com\/tag\/trid\/\">TRID<\/a> tolerance thresholds, as well as expanded error-correction provisions and reforms under the <a href=\"https:\/\/www.housingwire.com\/tag\/truth-in-lending-act\/\">Truth in Lending Act<\/a> and <a href=\"https:\/\/www.housingwire.com\/tag\/real-estate-settlement-procedures-act\/\">Real Estate Settlement Procedures Act<\/a> (RESPA), warning that limiting changes to smaller institutions would reduce their impact on costs and access to credit.<\/p>\n<p>The group also called for changes to servicing rules to ease loss mitigation, revisions to loan originator compensation standards, and updates to disclosure and underwriting requirements.<\/p>\n<p>The CFPB has been undergoing major restructuring under the second Trump administration. After former CFPB Director Rohit Chopra was fired from his position and Russell Vought was appointed as acting director, the agency <a href=\"https:\/\/www.housingwire.com\/articles\/vought-shuts-down-most-of-cfpbs-functions-cuts-off-funding\/\" target=\"_blank\" rel=\"noopener\">shut down<\/a>\u00a0most of its functions and closed its headquarters.<\/p>\n<p>In April 2025, the Trump administration\u00a0<a href=\"https:\/\/www.housingwire.com\/articles\/the-cfpb-announces-sweeping-job-cuts-up-to-90-gone\/\" target=\"_blank\" rel=\"noopener\">fired 90% of the CFPB\u2019s staff<\/a>, a move that was challenged in court and temporarily blocked.
