{"id":47787,"date":"2026-03-23T18:22:29","date_gmt":"2026-03-23T15:22:29","guid":{"rendered":"https:\/\/mk.gen.tr\/compass-seeks-to-dismiss-tcpa-lawsuit-over-agent-calls\/"},"modified":"2026-03-23T18:22:29","modified_gmt":"2026-03-23T15:22:29","slug":"compass-seeks-to-dismiss-tcpa-lawsuit-over-agent-calls","status":"publish","type":"post","link":"https:\/\/mk.gen.tr\/tr\/compass-seeks-to-dismiss-tcpa-lawsuit-over-agent-calls\/","title":{"rendered":"Compass seeks to dismiss TCPA lawsuit over agent calls"},"content":{"rendered":"<p><strong>Compass<\/strong> is seeking to dismiss a Telephone Consumer Protection Act (TCPA) <a href=\"https:\/\/www.housingwire.com\/articles\/compass-telemarketing-lawsuit-oregon-telephone-consumer-protection-act\/\" target=\"_blank\" rel=\"noopener\">lawsuit <\/a>filed against it last June by plaintiff Jessica Murch.<\/p>\n<p>Filed in U.S. District Court in Portland, Ore., the lawsuit claims that Murch received at least four calls beginning in August 2024 from Rachel Olson, a Compass agent, asking if she was interested in selling her home, despite Murch\u2019s phone number being registered with the <a href=\"https:\/\/www.housingwire.com\/articles\/rocket-mortgage-faces-class-action-lawsuit-for-unsolicited-telemarketing-calls\/\" target=\"_blank\" rel=\"noopener\">Do Not Call Registry<\/a> for more than 31 days prior to Olson\u2019s first alleged call. Additionally, Murch says she does not own the property in question and never requested any brokerage services from Compass.\u00a0<\/p>\n<p>Despite requesting Olson and <a href=\"https:\/\/www.realtrends.com\/brokerage-profile\/compass-new-york-ny\/\">Compass<\/a> no longer call her, Murch claims she received several more calls over the next year, including calls in early June 2025 from another Compass agent Ansel Sanger, who was seeking to sell the same property Olson reached out about. During this call, Murch said she reiterated her request that the brokerage no longer call her.\u00a0<\/p>\n<p>In its motion to dismiss filed on Friday, Compass claims that Murch\u2019s complaint, which is seeking class action status, fails to \u201cestablish that Compass is liable for the alleged phone calls to Plaintiff.\u201d According to the filing, it was \u201cimproper\u201d to include Compass as defendants in the lawsuit and that Murch is seeking to \u201chold Compass vicariously liable for the alleged conduct of agents Olson and Sanger, who are independent contractors.\u201d<\/p>\n<p>The <a href=\"https:\/\/www.housingwire.com\/brokerage\/\">brokerage<\/a> goes on to claim that its policies, which Murch included in her complaint, show that Compass does not condone communication like that alleged in the complaint and \u201cexplicitly prohibits\u201d that type of communication.\u00a0<\/p>\n<p>\u201cExercising basic brand-protection measures and quality control is fundamentally different from control over the day-to-day manner and means of an independent contractor\u2019s telephone calls to potential prospects,\u201d the motion states. \u201cBecause Plaintiff cannot plead a viable theory of vicarious liability as a matter of law, the Court should grant Compass\u2019s Motion to Dismiss and dismiss Plaintiff\u2019s claims against Compass with prejudice.\u201d\u00a0<\/p>\n<p>The brokerage also asserts that it is \u201cconfident\u201d that Murch\u2019s allegations against Olson and Sanger are \u201cbaseless and will ultimately be dismissed.\u201d<\/p>\n<p>The brokerage has requested oral arguments regarding its motion to dismiss.\u00a0<\/p>\n<p>A<a href=\"https:\/\/www.housingwire.com\/articles\/keller-williams-faces-another-telemarketing-lawsuit\/\" target=\"_blank\" rel=\"noopener\"> similar lawsuit <\/a>also filed last June against<strong> Keller Williams<\/strong>, as voluntarily dismissed by the plaintiff last July.<\/p>","protected":false},"excerpt":{"rendered":"<p>Compass is seeking to dismiss a Telephone Consumer Protection Act (TCPA) lawsuit filed against it last June by plaintiff Jessica Murch.
