Eric Swalwell (D-Calif.) has dropped a lawsuit that accused <strong>Federal Housing Finance Agency <\/strong>(FHFA) Director <a href=\"https:\/\/www.housingwire.com\/articles\/gao-fhfa-pulte-investigation\/\">Bill Pulte<\/a> of violating federal privacy laws.<\/p>\n<p>The parties agreed to the \u201cdismissal of this action without prejudice, with each side bearing its own fees and costs,\u201d according to court filings. The move means that Swalwell could refile or amend the complaint at a later date.<\/p>\n<p><a href=\"https:\/\/www.housingwire.com\/articles\/eric-swalwell-fhfa-lawsuit\/\">Swalwell<\/a>, who is running for governor in California, had claimed that Pulte improperly accessed his mortgage records when referring him in November 2025 to the <strong>U.S. Department of Justice <\/strong>(DOJ) over allegations of mortgage and tax fraud. <\/p>\n<p>The referral asserted that Swalwell falsely identified his Washington, D.C., home as his primary residence to secure more favorable mortgage terms, even though he is a permanent resident of <a href=\"https:\/\/www.housingwire.com\/articles\/california-premium-market-trends\/\">California<\/a>.<\/p>\n<p>The FHFA, <strong>Fannie Mae<\/strong> and <strong>Freddie Mac<\/strong> were also listed as defendants. The <a href=\"https:\/\/www.housingwire.com\/articles\/2026-conforming-loan-limit\/\">FHFA<\/a> did not immediately reply to <strong>HousingWire<\/strong>\u2019s request for comment.<\/p>\n<p>The case was filed in the <strong>U.S. District Court for the District of Columbia<\/strong>, alleging violations of Swalwell\u2019s First Amendment rights and the Privacy Act of 1974.<\/p>\n<p>In the complaint, Swalwell said he did not lie on mortgage applications, stating he \u201cexplicitly disclaimed any intent to occupy\u201d the D.C. property. A sworn affidavit attached to the mortgage agreement made clear the home would be his wife\u2019s primary residence, not his own, the complaint noted.<\/p>\n<p>Swalwell also alleged that Pulte played a \u201ccentral role\u201d in President <a href=\"https:\/\/www.housingwire.com\/articles\/updated-list-of-all-trumps-actions-that-impact-housing\/\">Donald Trump<\/a>\u2019s efforts to use federal agencies to \u201cseek retribution against his political enemies,\u201d prompting DOJ investigations \u201cnakedly targeting some of the President\u2019s most outspoken critics.\u201d<\/p>\n<p>Swalwell served as an impeachment manager during Trump\u2019s second impeachment trial and also sued Trump over allegations that he incited the Jan. 6 insurrection at the U.S. Capitol.<\/p>\n<p>Pulte has made similar referrals with other public figures, accusing New York Attorney General <a href=\"https:\/\/www.housingwire.com\/articles\/letitia-james-fraud-charges\/\">Letitia James<\/a>, Sen. <a href=\"https:\/\/www.housingwire.com\/articles\/trump-accuses-california-sen-adam-schiff-of-mortgage-fraud\/\">Adam Schiff<\/a> (D-Calif.) and <strong>Federal Reserve <\/strong>Governor <a href=\"https:\/\/www.housingwire.com\/articles\/supreme-court-delays-ruling-on-lisa-cooks-future-at-the-fed\/\">Lisa Cook<\/a> of mortgage fraud based on alleged <a href=\"https:\/\/www.housingwire.com\/articles\/mortgage-occupancy-fraud-trump-politics-investors-lenders-housing-market\/\">occupancy<\/a> misrepresentations.<\/p>","protected":false},"excerpt":{"rendered":"<p>U.S. Rep.
