{"id":47324,"date":"2026-03-13T18:27:32","date_gmt":"2026-03-13T15:27:32","guid":{"rendered":"https:\/\/mk.gen.tr\/ct-realtors-smart-mls-weserv-dismissed-from-zea-suit\/"},"modified":"2026-03-13T18:27:32","modified_gmt":"2026-03-13T15:27:32","slug":"ct-realtors-smart-mls-weserv-dismissed-from-zea-suit","status":"publish","type":"post","link":"https:\/\/mk.gen.tr\/en\/ct-realtors-smart-mls-weserv-dismissed-from-zea-suit\/","title":{"rendered":"CT Realtors, Smart MLS, WeSERV dismissed from Zea suit"},"content":{"rendered":"<p>The <strong>Connecticut Association of Realtors<\/strong> (CT Realtors) and Connecticut-based <strong>Smart MLS<\/strong>, as well as Arizona-based <strong>West and Southeast Realtors of the Valley<\/strong> (WeSERV), have all been dismissed from the Zea lawsuit. <\/p>\n<p>Florida-based U.S. District Court Judge William Dimitrouleas dismissed the three defendants from the lawsuit on Thursday after adopting and approving Magistrate Judge William Matthewman\u2019s report and recommendations.\u00a0<\/p>\n<p>Matthewman filed <a href=\"https:\/\/www.housingwire.com\/articles\/zea-lawsuit-jurisdiction-dismissal\/\" target=\"_blank\" rel=\"noopener\">his report<\/a> in mid-February, in which he shared his thoughts on a motion to dismiss for lack of personal jurisdiction filed by CT Realtors, Smart MLS and WeSERV in October 2025.<\/p>\n<p><a href=\"https:\/\/www.housingwire.com\/articles\/nar-faces-new-antitrust-suit-over-alleged-steering\/\" target=\"_blank\" rel=\"noopener\">Filed in August<\/a>, the lawsuit claims that the defendants engaged in a \u201ccoordinated scheme\u201d to restrict consumer choice and maintain elevated prices, harming his <a href=\"https:\/\/www.housingwire.com\/brokerage\/\">brokerage<\/a> model.<\/p>\n<p>Plaintiff Jorge Zea runs <strong>www.snapflatfee.com<\/strong>, a brokerage that charges sellers a listing fee in exchange for limited services. Zea\u2019s firm syndicates listings data to the <a href=\"https:\/\/www.housingwire.com\/articles\/national-mls-consolidation-debate\/\">MLS<\/a> data feeds and forwards all buyer leads \u201cregardless of their origin\u201d directly to the seller. <\/p>\n<p>According to Zea, buyer\u2019s agents associated with the defendants <a href=\"https:\/\/www.housingwire.com\/articles\/nar-addresses-steering-in-latest-settlement-agreement-update\/\" target=\"_blank\" rel=\"noopener\">steer clients<\/a> away from properties that offer a reduced or nonexistent buyer\u2019s <a href=\"https:\/\/www.housingwire.com\/articles\/agent-fee-overpayment-cpc\/\">agent commission<\/a>. In his complaint, he argues that this steering is the result of the <strong>National Association of Realtors <\/strong>(NAR) and the other defendants not enforcing their own rules.\u00a0<\/p>\n<p>The rules in question relate to the mandatory display of a listing broker\u2019s contact information on the listing page in an IDX display; the commission lawsuit mandate for <a href=\"https:\/\/www.housingwire.com\/articles\/how-real-estate-brokerages-are-reducing-risk-in-buyer-representation\/\" target=\"_blank\" rel=\"noopener\">buyer agency agreements<\/a>; and the prohibition of MLS platforms from allowing users to search or filter results by the name of the listing broker or agent, or by the amount of compensation offered. <\/p>\n<p>By allegedly refusing to enforce these rules, Zea claims that the <a href=\"https:\/\/www.housingwire.com\/articles\/realtor-associations-mlss-push-back-on-steering-allegations\/\" target=\"_blank\" rel=\"noopener\">defendants<\/a> have competitively disadvantaged his discount-brokerage business.<\/p>\n<p>In his report, the magistrate judge found that the three defendants do not operate or conduct business in <a href=\"https:\/\/www.housingwire.com\/articles\/florida-housing-reform-2026\/\">Florida<\/a>. Additionally, he found that the ethics complaints and MLS issues cited in the complaint happened in <a href=\"https:\/\/www.housingwire.com\/articles\/connecticut-bill-private-listings\/\">Connecticut<\/a>, meaning that any alleged injury related to these defendants occurred from his business activities in Connecticut, not from conduct in Florida.\u00a0<\/p>\n<p>Zea did not file any objections to the magistrate judge\u2019s report. Despite the lack of objections, Dimitrouleas wrote in his order that the court still conducted its own review of the report, ultimately agreeing with the magistrate judge\u2019s analysis and conclusions.\u00a0<\/p>\n<p>While these three defendants are no longer facing Zea\u2019s allegations, NAR and several other Florida-based entities are. These include <strong>Beaches MLS<\/strong>; <strong>Broward, Palm Beaches &amp; St. Lucie Realtors<\/strong>; <strong>Miami Realtors<\/strong>; <strong>Orlando Regional Realtor Association<\/strong>; <strong>Florida Gulf Coast MLS<\/strong>; <strong>Stellar MLS<\/strong>; <strong>Space Coast MLS<\/strong> and <strong>Space Coast Association of Realtors; RealMLS<\/strong>; <strong>Northeast Florida Association of Realtors<\/strong> and <strong>Central Panhandle Association of Realtors<\/strong>.\u00a0<\/p>\n<p>CT Realtors, Smart MLS and WeSERV did not immediately respond to <strong>HousingWire<\/strong>\u2019s requests for comment.<\/p>","protected":false},"excerpt":{"rendered":"<p>The Connecticut Association of Realtors (CT Realtors) and Connecticut-based Smart MLS, as well as Arizona-based West and Southeast Realtors of the Valley (WeSERV), have all been dismissed from the Zea lawsuit.
